Terms of service
The short version
- Calybee is software: a website builder and booking system you subscribe to. It is not a payment service. Money your clients pay you never passes through Calybee.
- Calybee has a free plan and paid plans. During early access everything is free, and nothing is charged without at least 30 days’ notice and your agreement.
- Paid plans are sold by Paddle, our online reseller and Merchant of Record. You can cancel any time. A mistake on our side is always refunded; a change of mind only within 15 days of your first payment for a plan.
- You own your content and your client list. You can leave whenever you like.
- Your clients pay you through your own Stripe or PayPal account. We are not part of that sale and take no commission.
- You are responsible for your business, your prices, your policies and how you treat your clients’ data.
- Calybee is provided as it is, while we build it. Please keep your own records of anything critical.
1. The agreement
These terms are an agreement between you and Mrutyunjaya Mishra, an individual based in India, who operates Calybee (“Calybee”, “we”, “us”). By creating an account or using Calybee you accept them, together with our privacy policy, our acceptable use policy and, where it applies, our data processing agreement.
What Calybee is, and is not. Calybee is software as a service: tools to build a website, take bookings, send booking emails and manage clients. The only thing Calybee sells is a subscription to that software, through Paddle (section 2). Calybee is not a payment processor, payment facilitator, marketplace, money transmitter, escrow service or bank. It never receives, holds, moves or pays out money on behalf of you or your clients, and it is never the seller of what you sell to your clients.
Calybee is for businesses. You must be at least 18 and use Calybee for your trade, business, craft or profession. If you accept these terms for a company or organisation, you confirm you have the authority to bind it, and “you” means that organisation.
2. Plans, payment and early access
Plans. Calybee has a free plan and paid plans, Widgets and Complete. What each includes and its current price are on our pricing page. Prices are per month, billed monthly or yearly, in US dollars or euros. Taxes such as VAT are added at checkout where they apply.
Early access. Calybee is in early access, and every feature is free during this period. Features may be added, changed or removed as we learn what works. Before a paid plan can charge you, we will email you at least 30 days ahead, and you will only be charged if you choose a paid plan.
Who sells the plans. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. When you buy a plan, you also agree to Paddle’s terms for buyers, which Paddle shows at checkout.
Renewal and cancelling. A paid plan renews automatically at the end of each billing period, monthly or yearly, until you cancel. You can cancel at any time from your account, through the link in your Paddle receipt, or by writing to support@calybee.com. Your plan then runs to the end of the period you paid for and 14 more days, and your account moves to the free plan. Nothing is deleted.
Price changes. We will email you at least 30 days before a new price applies to you. It applies from your next billing period, and you can cancel before then.
Refunds. We refund a payment when the fault is ours, such as a billing mistake or a charge after you cancelled. A change of mind is refunded only within 15 days of your first payment for a plan; renewals and unused time are not refunded. The details are in our refund policy.
Payment processors you connect for your own clients, such as Stripe or PayPal, charge you their own fees under their own terms.
3. Your account
- Give accurate information and keep it up to date.
- Keep your password safe. You are responsible for what happens in your account, including actions by team members you invite and by apps you connect, such as Claude.
- Tell us straight away at support@calybee.com if you think someone has accessed your account without permission.
4. Your content and your clients
You own your content. Your text, images, services, prices, policies and client records remain yours. You give us a worldwide, non-exclusive, royalty-free licence to host, copy, display, adapt (for example resize an image or translate text when you ask us to) and transmit that content only as needed to run Calybee for you and to show your site to the public. The licence ends when you delete the content or close your account, except for copies in backups that roll off on their normal schedule.
You are responsible for your content and your business. That includes:
- having the right to publish everything you upload, including photos, logos and reviews;
- the services you offer, the prices you charge and how you deliver them;
- your own legal documents, such as terms, cancellation and privacy policies. Calybee gives you a place to publish them but does not write them for you;
- any content you publish that was drafted with help from Claude or another tool; please read it before it goes live; and
- only publishing reviews that real clients gave.
Your clients’ data. When you use Calybee to collect information about your clients, you are the controller of that data and we process it for you under our data processing agreement, which forms part of these terms. You are responsible for having a lawful basis to collect it, for telling your clients how you use it, and for answering their requests. Only ask for information you need. Calybee is not designed for protected health information; if you are a US healthcare provider covered by HIPAA, do not use Calybee to store patient records.
5. Payments between you and your clients
- When you connect Stripe or PayPal, your clients pay you directly on that provider’s own page, under your own agreement with that provider. The money goes straight to your provider account. Calybee never holds, moves or controls your funds, is never the merchant of those sales, and takes no commission.
- Connecting a provider is optional. Calybee works fully without one, and a service can be paid at the visit.
- The sale is between you and your client. You are responsible for your prices, taxes, invoices and receipts, refunds, chargebacks and disputes, and for following your provider’s terms.
- If you choose an automatic refund rule, Calybee asks your provider to make refunds according to that rule. Check the setting matches your cancellation policy.
- Gift cards, packs and memberships you sell are your promise to your clients. You are responsible for honouring them and for any rules that apply to them where you trade.
- Calybee is not responsible for a provider’s outages, fees, holds or decisions about your account.
6. Emails sent for you
Calybee sends booking emails, such as confirmations, reminders, changes, cancellations and review requests, on your behalf to people who booked with you or your team. They are sent from a Calybee address under your business name, with replies going to you. You are responsible for their content. Do not use Calybee to send marketing to people who have not asked for it.
7. Other services and AI
Calybee can connect to services run by others, including Google Calendar and Google Meet, Claude by Anthropic, Stripe, PayPal, Paddle and analytics tools. Your use of each is governed by that provider’s terms. We do not control them and are not responsible for them, and a connection may stop working if the provider changes or withdraws it.
Content generated by AI, including by the Bee and by Claude working through the Calybee connector, can be wrong. Review it before you publish it or rely on it. You are responsible for what you ask the AI to make and for what you publish, and you may not use it to make anything our acceptable use policy forbids, or to copy someone else’s work, likeness or voice without their permission.
Reporting content. If something on a site made with Calybee infringes your rights or breaks our acceptable use policy, email support@calybee.com with the page’s address and what is wrong. We review every report and may remove the content or suspend the site, and we close the accounts of people who infringe again and again.
8. Acceptable use
You agree to follow our acceptable use policy. In short: nothing illegal, harmful, deceptive or abusive, and nothing that attacks or overloads Calybee.
9. The service
We work hard to keep Calybee available, secure and reliable, but during early access we do not promise any particular uptime. We may change or discontinue features. If we decide to shut down Calybee entirely, we will give you at least 30 days’ notice and help you get a copy of your data.
Keep your own copy of anything you cannot afford to lose, such as client contact details and upcoming appointments. You can ask us for an export of your data at any time.
10. Ending or suspending
You can stop using Calybee at any time and ask us to delete your account at support@calybee.com.
We may suspend or close an account if it breaks these terms or the acceptable use policy, if a payment for a paid plan fails and is not put right, if it puts other users, their clients or Calybee at risk, or if the law requires it. Where we reasonably can, we will tell you first and give you a chance to fix the problem. When an account closes, your public site stops working and we delete your data as described in the privacy policy.
Sections 4 (responsibility for content), 5, 11 to 15 and 17 continue after the agreement ends.
11. Our intellectual property
Calybee’s software, design, templates, illustrations and name belong to us. You may use them only to build and run your own Calybee site. You may not copy, resell or reverse-engineer the service except where the law allows. If you send us feedback or ideas, we may use them without owing you anything.
12. Disclaimers
To the extent the law allows, Calybee is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that Calybee will be uninterrupted or error-free, or that it will bring you bookings or revenue.
13. Limits on liability
To the extent the law allows:
- we are not liable for indirect, incidental, special, consequential or punitive losses, or for lost profits, revenue, bookings, goodwill or data; and
- our total liability for all claims relating to Calybee is limited to the greater of the amount you paid us in the 12 months before the claim and 100 US dollars.
Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud or for death or personal injury caused by negligence.
14. Indemnity
You will compensate us for reasonable costs, losses and claims brought by others that arise from your content, your services, your dealings with your clients, or your breach of these terms or of the law.
15. Governing law and disputes
These terms are governed by the laws of India, and the courts of India have jurisdiction, unless the law where you are based gives you the right to bring a claim in your own courts. Before starting a formal dispute, please email us so we can try to sort it out.
16. Changes to these terms
We may update these terms. For significant changes we will email account holders at least 30 days before they take effect. If you keep using Calybee after that, the new terms apply; if you do not agree, you can close your account.
17. General
If part of these terms cannot be enforced, the rest still applies. If we do not enforce a right straight away, we have not given it up. You may not transfer this agreement without our consent; we may transfer it as part of a sale or reorganisation of Calybee, and these terms will continue to protect you. These terms, with the documents they refer to, are the whole agreement between us about Calybee.
